Clinical negligence, litigation and healthcare-associated infections

背景
医療関連感染に関する医療過誤賠償請求の訴訟費用は甚大であるが、医療機関はこの費用を過小評価している。英国では、国民保健サービス（NHS）を代表して NHS 訴訟局（National Health Service Litigation Authority；NHSLA）が、これらの賠償請求を取り扱っている。近年は、賠償請求の総件数や裁定額は大幅に増加している。
目的
近年の英国におけるメチシリン耐性黄色ブドウ球菌（meticillin-resistant Staphylococcus aureus；MRSA）血流感染症（BSI）およびクロストリジウム・ディフィシル（Clostridium difficile）感染症の大幅な減少が、これらの感染症に関連する NHSLA の賠償請求の件数および金額に影響しているかどうかを明らかにすること。
方法
C. difficile または MRSA について記載された 2003 年から 2010 年の賠償請求のデータを NHSLA から入手し、これらのデータと、感染症に関する健康保護局（Health Protection Agency；HPA）の義務的サーベイランスのデータとの関連を評価した。
結果
MRSA BSI 発生件数あたりの NHSLA の MRSA に関する賠償請求の件数は、MRSA BSI の減少とともに減少したが（2003 年 4 月 ～ 2006 年 7 月の BSI 1 件あたり 0.007 件から 2007 年 8 月 ～ 2010 年 11 月の 0.0017 件へ）、C. difficile 感染症に関する賠償請求には有意な変化は認められなかった。支払いが確定した賠償請求の総裁定額は、1997 年 8 月 ～ 2006 年 7 月の 76,846 ポンドから 2007 年 8 月 ～ 2010 年 11 月の 24,821 ポンドへ有意に減少した。
結論
近年、MRSA に関する賠償請求の訴訟件数は、サーベイランスデータにみられる MRSA BSI の減少とともに有意に減少している。C. difficile に関する賠償請求には影響は認められなかった。両感染症に関する支払いが確定した賠償請求の裁定額も減少しているが、その理由については不明である。
